These terms and conditions (“terms”) apply to all customers who agree to join the TM Customer Panel (“Customer Panel”). By agreeing to join the Customer Panel, you agree to be bound by these terms. We may update these terms from time to time. Any updates will be posted to this page and will apply to everyone on the Customer Panel, so please check back frequently. You should also read our general Terms & Conditions, Privacy Notice and Cookies Policy before you decide to join the Customer Panel.
We are TotallyMoney Limited (“TotallyMoney”, “We” or “Our”). We own and operate the personalised financial essentials website, www.totallymoney.com, and the TotallyMoney app. We provide a range of free services to help you better understand and improve your financial situation. TotallyMoney Limited is a company registered in England (No. 06205695), with VAT number 974859255. Our registered office address: 5th Floor, Halo, Counterslip, Bristol, BS1 6AJ and trading office address: White Collar Factory, 1 Old Street Yard, London EC1Y 2AS.
The Customer Panel aims to improve our service and develop new features that are driven by our customers’ wants, needs and challenges. The Customer Panel is made up of existing customers only. We may ask you to participate in a variety of different activities (“Panel Activities”) which include but are not limited to:
Phone and video interviews
Face-face interviews
Usability tests
Surveys and questionnaires
Diary studies
Focus groups and workshops
Events, filming, photos, and/or testimonials.
Some of these Panel Activities will be hosted by third party platforms. Please see section 8 of these terms for more details on how we work with third party platforms.
You recognise that by joining the Customer Panel we cannot guarantee your participation nor are you obliged to participate in any of the Panel Activities. Certain Panel Activities may be subject to additional terms and conditions which will be made available to you from time to time.
Eligible customers will be invited to join the Customer Panel. By joining our Customer Panel, you agree to provide true, accurate, current and complete information when participating in Panel Activities. You will refrain from creating, promoting or participating in any inappropriate behaviour or content. We reserve the right to terminate or suspend your access to the Customer Panel at any time if we suspect or discover that your participation is in violation of these terms.
By accepting these terms, you acknowledge that they do not constitute an employment contract and nothing in these terms shall be deemed to create any obligation on you to remain on the Customer Panel. You can opt out of any Panel Activity or leave the Customer Panel at any time. For more information on leaving the Customer Panel, please see section 7 of these terms.
As part of joining the Customer Panel, customers will have the opportunity to be rewarded for taking part in Panel Activities. These rewards include monthly prize draws, ad hoc prize draws and rewards for longer Panel Activities (e.g. vouchers or cash rewards). Unless otherwise stated, all prize draws will be governed by the terms and conditions set out below. Any additional terms that are applicable to a particular prize draw will be communicated to you.
Prize draws are only open to customers of TotallyMoney, except employees of TotallyMoney, their families, agents or any third party directly associated with administration of the prize draw. By entering a prize draw, you confirm that you are eligible to do so and eligible to claim the prize you may win. TotallyMoney may require you to provide proof that you are eligible to enter a prize draw. TotallyMoney will not accept prize draw entries that are:
automatically generated by computer;
completed by third parties or in bulk;
illegible, have been altered, reconstructed, forged or tampered with; or
incomplete.
TotallyMoney reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw. Prize draw entries cannot be returned.
By entering a prize draw, you grant us a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the prize draw entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the prize draw entry and any accompanying materials for such purposes.
Prize draws are free to enter, and you will be automatically entered into monthly prize draws. If you do not wish to be entered into the monthly prize draw, please email us at [email protected].
Only one entry per person is permitted. The opening and closing dates for entry and prizes available will be communicated to you from time to time. Entry routes for ad hoc prize draws will be specified in the relevant communication but may be via a third party. Entries received after the closing date will not be considered. TotallyMoney accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
Winners will be chosen by random draw within seven (7) days of the closing date and will be notified by email (using details provided at entry) within thirty (30) days of the closing date. If a winner does not respond to TotallyMoney within fourteen (14) days of being notified by TotallyMoney, then the winner’s prize will be forfeited and TotallyMoney will be entitled to select another winner in accordance with the process described above. The prize will be sent to the winner by email within ten (10) working days of being notified of their win. The prize for the winner is non-exchangeable, non-transferable and no alternative is offered.
The prize is supplied by TotallyMoney Limited. TotallyMoney reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond TotallyMoney’s control makes it necessary to do so. TotallyMoney’s decision regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it. A prize draw winner’s name and county can be obtained by sending an email to [email protected] within ninety (90) of days after the closing date.
Participants are deemed to have accepted and agreed to be bound by these prize draw terms and conditions upon entry. TotallyMoney reserves the right to refuse entry or refuse to award a prize to anyone in breach of these terms and conditions. TotallyMoney reserves the right to hold void, cancel, suspend, or amend the prize draw where it becomes necessary to do so. Insofar as is permitted by law, TotallyMoney, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a prize except where it is caused by the negligence of TotallyMoney, its agents or distributors or that of their employees. Your statutory rights are not affected.
We or our licensors own all intellectual property and other proprietary rights in and to the website, app and any Customer Panel materials. By choosing to participate in the Customer Panel, you acknowledge that you are participating in research and you agree:
to give us a royalty-free, perpetual, irrevocable, non-exclusive licence (with the right to sublicence) to be able to use any content you provide as part of your participation in the Customer Panel;
to keep confidential any research we carry out as part of the Customer Panel;
that any content you provide as part of your participation in the Customer Panel is your sole and entire responsibility;
that TotallyMoney can use any results of the Panel Activities, including information, ideas, responses and feedback provided by you, in relation to the development and improvement of TotallyMoney’s products, services and marketing materials; and
that any anonymised feedback can be used in TotallyMoney’s publicity materials.
In addition to the above, you also warrant that none of the material you provide to us either directly or indirectly plagiarises or infringes the intellectual property rights of any third party.
After joining, you will remain a member of the Customer Panel for as long as you are still a TotallyMoney customer or until you wish to leave the panel. You can request to leave the Customer Panel at any time by clicking on the “Leave the panel” button in our email correspondence with you or by emailing [email protected].
If you request to leave by clicking the “Leave the panel” button, this request will be processed promptly and you should not receive any further invitations or communications from us regarding the Customer Panel. If you request to leave via email, there may be a slight delay in processing your request. We will honour any prize draws or rewards that you win up until date that you decided to leave the Customer Panel.
We are not responsible for any errors or omissions in the content of any third-party platforms or websites (e.g. Alchemer or UserTesting.com) or any changes or updates to such platforms or sites that we may use from time to time. If we ask you to use a third-party platform, you will be subject to that platform’s Terms & Conditions and Privacy Policy. For example, if you agree to take part in Alchemer testing, you will also be subject to their Terms & Conditions and Privacy Policy which can be found on their website https://www.alchemer.com/.
By agreeing to join the Customer Panel, you give us permission to use your personal information to check your eligibility for Panel Activities. We will send you invitations and other panel correspondence by email. We will use any personal data you submit or give us access to in accordance with our Privacy Notice which you can find here.
If TotallyMoney considers that there has been a breach of these terms, then it may, at its sole discretion, exclude you from participating in the Customer Panel. These terms and your participation in the Customer Panel are governed by and construed in accordance with the law of England Wales. Any disputes (including non-contractual disputes or claims) will be decided only by the Courts of England and Wales.
